Abstract

After the amendment of the 1945 Constitution of the Republic of Indonesia, there is a check and balance mechanism in the legislative mechanism in Indonesia. The President and DPR RI are state institutions that are given the power by the constitution to formulate and enact laws. The constitution also gives power to the judiciary to ensure that the products of legislation are not arbitrary. This condition requires a pattern of relations in which state institutions given the constitutional mandate understand the scope of the legislative power possessed by each institution.
